Terms and Conditions

1. Introduction

These general terms and conditions (the “Terms“) govern the rights and obligations of the parties when buying goods and ordering services through the Kávová pohotovosť online shop, available at kavovapohotovost.sk (the “shop“).

  • Seller — the operator of the shop, identified in section 2.
  • Buyer — the natural or legal person entering into a contract with the seller through the shop.
  • Consumer — a natural person who, when entering into and performing the contract, is not acting in the course of their business.

The legal relationship between the seller and a consumer is governed by these Terms and, in particular, by Slovak Act No. 108/2024 Coll. on Consumer Protection and Act No. 40/1964 Coll. (the Civil Code). Where the buyer is a business (purchasing under a Company ID), the relationship is governed by the Commercial Code. Any provision of these Terms that conflicts with the consumer’s mandatory statutory rights does not apply to the consumer’s disadvantage.

3. Orders and conclusion of the contract

The buyer orders goods or a service by completing and submitting the order form in the shop. Before submitting, the buyer can review and change the details and read these Terms; by submitting the order, the buyer confirms they have read them.

A submitted order is a proposal to conclude a contract. The contract is concluded at the moment the seller sends the buyer an order confirmation to their e-mail address. The confirmation includes a summary of the order and these Terms.

4. Prices

Prices are shown with each product in the shop, in euros (EUR). The delivery cost is shown before you complete the order and is stated separately. The binding price is the one valid when the order is submitted.

5. Payment

The buyer may pay for an order by:

  • payment card (e.g. Visa, Mastercard) and possibly Apple Pay / Google Pay via the payment gateway Mollie; card details are entered directly with the gateway provider;
  • bank transfer to the seller’s account SK69 0900 0000 0052 3258 7907; please use your order number as the payment reference (variable symbol); goods are dispatched once payment is credited;

6. Delivery

We deliver within the Slovak Republic and the EU by:

  • Packeta (Zásielkovňa) — delivery to a pickup point or to your address; Delivery costs are paid by the buyer.;
  • personal pickup — Zuzany Chalupovej 17, 851 07 Bratislava, Slovakia.

The usual delivery time is 2–5 business days from conclusion of the contract, or from crediting of payment where paid in advance. If the goods cannot be delivered within this time, the seller will inform the buyer.

7. Ownership and passing of risk

The buyer acquires ownership of the goods on taking delivery, but no earlier than full payment of the purchase price. The risk of damage to the goods passes to the buyer at the moment of receipt.

8. Withdrawal and return of goods

A consumer has the right to withdraw from a distance contract within 14 days without giving a reason. The detailed conditions, time limits, costs, and a model form are set out in the Complaints (Returns & Refunds) Policy, which forms an integral part of these Terms.

9. Complaints and liability for defects

The seller is liable for defects in the goods to the extent and under the conditions laid down by the Civil Code. How to make a complaint, the time limits for handling it, and the consumer’s rights in the event of a defect are set out in the Complaints Policy.

10. Repair service for coffee machines

The seller also provides repair and servicing of coffee machines. The terms of a specific repair (scope, price, time) are agreed when the device or service order is received. As a service, a repair is subject, as appropriate, to the provisions on withdrawal and on liability for defects set out in the Complaints Policy, section “Repair service”.

11. User account and forum

Registration is not required to make a purchase, but the buyer may create a user account. The website also includes a community forum for coffee lovers.

  • The buyer/user must provide accurate details and protect their login credentials.
  • The user is responsible for the content they publish in the forum; they must not post unlawful, offensive, misleading, or rights-infringing content, or unsolicited advertising.
  • The seller may moderate, edit, or remove content that breaches these rules and, in justified cases, suspend or delete an account.

12. Personal data protection

The processing of buyers’ and users’ personal data is governed by the Privacy Policy.

13. Alternative Dispute Resolution

A consumer has the right to ask the seller for redress if dissatisfied with how a complaint was handled. If the seller rejects the request or does not respond within 30 days, the consumer may file a petition for alternative dispute resolution under Act No. 391/2015 Coll. The competent entity is the Slovak Trade Inspection (Slovenská obchodná inšpekcia) (www.soi.sk); a list of other entities is kept by the Ministry of Economy of the Slovak Republic (www.mhsr.sk).

14. Final provisions

These Terms and the contractual relationships are governed by the law of the Slovak Republic. The seller reserves the right to amend these Terms; a concluded contract is governed by the version of the Terms in force when the order was submitted. If any provision of these Terms is invalid, the remaining provisions stay in force.
